StarkGames, LLC, with company ID number 192585427, with headquarters located at Belarus, Minsk 220004, st. Klary Cetkin, 51A, 11th floor (“StarkGames” or “We”) welcomes You – our online users (“users” or “You”). These TERMS OF USE of use apply to any services that We may provide through any StarkGames website (collectively, the “Site”), or any StarkGames game or application (the Site, games and applications are, collectively, the “Service”). These TERMS OF USE are a legal agreement and contain important information about Your rights and obligations in relation to our Services.

1. If You do not agree to these TERMS OF USE or any future updated version of them then You must not access and/or use, and must cease all access and/or use of, any of our Services. These TERMS OF USE are made available via an app store or  platform from which You download our Games (such as the Apple App Store, Google Play Store etc.), on any website or platform where you can play our Games such as facebook.com, my.com, vk.com, mail.ru etc. and on our website (the “website”). You agree that by accessing and/or using our Services, You are agreeing to these TERMS OF USE and our Privacy Policy.
3. Our Services are not intended for children under 16.

You represent and warrant that you are at least 16 years of age. If you are younger than the required age, you may not set up an account. If we discover that you have created an account and you are younger than the required age for consent to use online services, we will terminate your account. And you may be requested to verify your identity.

If You do create an account with us, You agree that You shall take all steps necessary to protect Your log-in details and keep them secret. You agree that You shall not give Your log-in details to anyone else or allow anyone else to use Your log-in details or account. In case You were not able to keep the information for entering the account secret, You accept full responsibility for the consequences (including unauthorized purchases), and also agree to be fully responsible for any damage or loss that may arise in this regard.

You must notify us immediately upon learning that someone else may be using your account without your permission (or if you suspect any other breach of security) by contacting our support team support@stark.games.

You understand that if You delete Your account or our Service or if We delete Your account or our Service in accordance with these TERMS OF USE, You may lose access to any data previously associated with Your account or our Service (including, without limitation, Your progress through our Games and/or the level or score You achieve in our Games and any Virtual Money or Virtual Goods associated with Your account).
7. You acknowledge and agree that You shall have no ownership or other property interest in any account that You create using any of our Services. We may suspend, terminate, modify or delete any of these accounts at any time for any reason or no reason, with or without notice to You, including removal of Service at any time. At the same time, Stark Games will make every effort so that the work of the Service is carried out as long as possible.
8. You must comply with the laws that apply to You in the location from which You access our Services. If any laws applicable to You restrict or prohibit You from using our Services, You must comply with those legal restrictions or, if applicable, stop accessing and/or using our Services.
9. You understand and agree that all Content that You may send when using our Services, whether publicly posted or privately sent, is the sole responsibility of the person that sent the Content. This means that You, not us, are entirely responsible for all Content that You may upload, communicate, transmit or otherwise make available via our Services.

Whilst You are in compliance with these TERMS OF USE, We grant You a non-exclusive, non-transferable, personal, revocable limited license to access and/or use our Services (but not any related object and source code) for Your own personal private use, in each case provided that such use is in accordance with these TERMS OF USE. You agree not to use our Services for anything else. These TERMS OF USE also apply to any update or patches which We may release or make available for any of the Services and any such update or patch shall be deemed part of the Services for the purposes of these TERMS OF USE.

We have the right to delete downloaded Materials (any information, including, but not limited to data, files, software, tags, links that can be sent, downloaded, sent, transmitted and provided in another way by You or other users through our Services), if We at our sole discretion recognize that such Materials entail a violation of the TERMS OF USE or part thereof, or are caused by such, or may impair our reputation or the reputation of our Services.

• disrupt the normal course of work of the Service in a way which may adversely affect the fair competition between other players while using our Services;
• carry out attacks on servers or networks of Services or platforms on which Services are located.

17. When using the Services, it is forbidden to:

• create more than one account per platform to access our Services;
• use the personal or technical data of third parties for registration or other access to our Services (e-mail, phone numbers, passport data, registration addresses, etc.);
• convey to third parties or users of the Services the personal data of users of the Services (including, but not limited to email addresses, phone numbers, passport data, personal images of users of the Services, registration addresses, etc.);
• conduct surveys or contests organized by the Users of the Services, create financial pyramids, send chain letters, send unsolicited mail, spam, or any other repeated or unclaimed messages (commercial or other nature);
• defame, insult, harass, threaten or otherwise violate the legitimate rights (such as the right to non-interference in privacy and publicity) of users;
• use information about other users of the Services, except when such information is public due to the settings of the platform on which the Service is located;
• impersonate another person or organization or otherwise create the appearance of a connection with any person, organization and thus mislead other users, including for fraudulent activities or abuse;
• post advertisements or commercial offers, campaigning information or any other intrusive information on the Services, except as otherwise permitted in writing by StarkGames;
• delete or change any notices of ownership or other information about the owner from our Services or any part of our Services;
• sell, transfer or try to sell or transfer an account in our Service (as well as outside the Service) or part of an account, including any Virtual Money and / or Virtual Goods of the Service.
• exploit vulnerabilities or errors of the Service or special technical solutions described in these TERMS OF USE for the purpose of obtaining unreasonable gaming advantages (violating standard gameplay).

18. Without limitation with respect to any other remedy or any other paragraph of these provisions, if We reasonably assume that You are violating the TERMS OF USE, with or without prior notice (including repeatedly committing minor violations), We reserve the right to take any of the following actions, individually or collectively:

• delete, suspend and / or change Your account or its part;
• block access to our Service;
• change the quantity of and / or delete any Virtual money or Virtual goods associated with Your account;
• reset and / or change any game progress or game features associated with Your account.

In accordance with the requirements of the law, You hereby agree to reimburse us any losses, damage, claims and expenses that may arise as a result of your violations of the TERMS OF USE.

19. We do not guarantee that any of our Services will be free from errors at any time or currently. The services are provided “as is”, “as available” and without warranty of any kind, express or implied, including, but not limited to, the implied warranties of title, non-infringement, and any warranties implied by any course of performance. We do not warrant that: (i) the services will be secure or available at any particular time or location; (ii) any defects or errors will be corrected; (iii) any content or software available at or through the services is free of viruses or other harmful components; or (iv) the results of using the services will meet your requirements. your use of the services is solely at your own risk. some states do not allow limitations on implied warranties, so the foregoing limitations may not apply to you.

We do not guarantee that the services will function without interruption or errors. In particular, the operation of the services may be interrupted due to maintenance, updates, or system or network failures, and such failures may result in errors or data loss. We disclaim all liability for damages caused by any such interruption or errors in functioning, or by the loss of any data or information you provide to us. Furthermore, we disclaim all liability for any malfunctioning, impossibility of access, or poor use conditions of the services due to inappropriate equipment, disturbances related to internet service providers, to the saturation of the internet network, and for any other reason.

We are committed to providing our Services in accordance with all statutory standards. With regard to Virtual Money and / or Virtual Goods, or any part of our Services that were paid for with real money, We guarantee that such Services in their main characteristics will correspond to their description provided at the point of purchase and will be of satisfactory quality. Services will be provided with reasonable integrity and at a reasonable level.
